近日,“重庆10人聚餐9人开溜,剩下1人不愿买单”的事件引发热议,相关话题登上热搜第一。
A recent incident in Chongqing, where nine out of ten diners left a meal without paying — leaving one person alone to face the bill — has sparked heated discussion online, topping trending lists.
据重庆电视台《天天630》报道,12月4日,有10人相约到重庆九龙坡区一家餐馆聚餐,一共消费1262元,但散席后现场仅剩张先生一人。
餐馆要求张先生结账时,张先生却称此次聚餐为朋友组局,应由对方付款,自己无力承担。
According to a report by Chongqing TV's Everyday 630, ten people gathered for a meal at a restaurant in Jiulongpo district on Dec 4, with the bill totaling 1,262 yuan. When the group dispersed, only one customer, identified as Zhang, remained.
When asked by the restaurant to settle the bill, Zhang explained that the meal had been organized by a friend who should have paid. He said he could not afford the full amount himself.

无奈之下,餐馆老板陈先生报警求助。
据陈先生介绍,经过民警调解,张先生现场写下了承诺书,答应第二天下午6点前支付用餐费用,并押下了身份证。
With no other solution, restaurant owner surnamed Chen called the police. After mediation by officers, Zhang wrote and signed a handwritten commitment letter, promising to pay the bill by 6 pm the following day and leaving his ID card as security.
另据红星新闻12月13日报道,该份手写承诺书上,张先生写明了自己的个人信息、用餐地点、金额,还承诺称“如果未能在约定时间支付,本人愿意承担一切法律责任”。
As reported by Red Star News on Dec 13, the letter included Zhang's personal details, the restaurant’s name, the bill amount, and a statement that he would "bear all legal responsibility" if payment was not made on time.
餐馆报警后,民警来到店里调解
12月14日,澎湃新闻从该餐馆负责人陈先生处获悉,经过民警调解,食客张先生已将所欠餐费支付,事情已解决。

律师解读
北京市兰台(上海)律师事务所高级合伙人徐红梅律师表示,餐馆有权要求留守的张先生支付全额餐费。10人共同消费构成民法典规定的“多数人之债”,餐馆作为债权人,可要求任一共同债务人支付全部费用,该内部分担约定不能对抗餐馆的收款权利。而张先生签署承诺书明确愿意承担付款义务,进一步确认了其付款责任,餐馆据此可单独向其主张全额餐费。
无论认定为哪种法律关系,承诺书均是张先生真实意思表示,具有法律效力。其无故反悔构成违约,餐馆可通过诉讼要求其履行付款义务并主张损失。张先生支付后,可依据约定或法律规定,向其他9人追偿各自应分摊的费用。
According to Xu Hongmei, senior partner at Landon (Shanghai) Law Firm, the restaurant has the right to demand full payment from Zhang, as he was present when the bill came due. The ten individuals formed a "joint debt" under China's Civil Code, making each jointly liable for the full amount. Any internal agreement among them cannot override the restaurant’s right to collect payment from any one of the diners.
By signing the commitment letter, Zhang explicitly accepted the payment obligation, strengthening the restaurant's claim against him. Should he fail to pay, the restaurant may sue for breach of contract and seek damages. If Zhang pays in full, he may then seek reimbursement from the other nine for their shares.
徐红梅强调,根据民法典相关规定,10人共同聚餐与餐馆构成餐饮服务合同关系,属共同债务人,对1262元餐费承担连带责任。无明确约定或明显过错时,因无法确定各自责任大小,应按公平原则平均分摊,每人承担126.2元。
若有人能举证自身消费与他人存在明显差异,可主张调整分摊金额;若有证据证明某人明确作出“请客”意思表示,则由该人承担全部餐费,其他人无需分摊。但若无此类明确意思表示,不能随意推定某人为宴请方,仍需按共同消费的公平原则确定分摊责任。
Xu added that under the Civil Code, the group formed a joint dining contract with the restaurant, creating shared liability for the 1,262 yuan bill. Regardless of if the diners made a prior agreement or evidence of uneven consumption, the amount should be divided equally — approximately 126.2 yuan per person.
If someone can prove their consumption differed significantly from others', they may request an adjusted share. Likewise, if evidence shows one person clearly offered to treat the group, that person would bear the full cost. Without such proof, however, liability should be shared fairly among all participants.
