在白纸上签名有哪些风险?
《法治日报》报道,北京汇祥律师事务所律师张茜曾表示,在白纸上签名可能会被他人盗用、冒用,伪造协议等文件,增加己方对于文件真实性、合法性的举证责任,或者被用于欺诈他人,存在一定法律风险。
Legal experts warn that signing blank paper carries significant evidentiary risks. Lawyer Zhang Qian from Beijing-based Allwell Law Firm said such signatures can be altered or used to fabricate agreements, leaving signers responsible for proving a document’s authenticity.
签字人如果主张不知晓内容,可以申请对文件上的笔迹形成时间、不同笔迹墨水成分、文件不同部位的形成先后顺序进行鉴定。如果能够确认文件系伪造,即可免除法律责任。
律师提醒,白纸签名隐患多,不要轻易在空白纸上签名,如确需签名,须在签名旁边备注用途。同时,要求相对人提供收条,注明收到自己签名的空白纸页数及所需用途,防止引发不必要的法律风险。
