餐品中有异物如何维权?女子螺蛳粉里吃出菜花蛇,店家回应引热议
A meal at a luosifen (river snail rice noodles) stall in Nanning, Guangxi Zhuang autonomous region, yielded an unsettling discovery when a customer spotted a small snake in her bowl. The woman immediately recognized it as a snake from its head and markings, took photos as evidence and alerted a staff member.
To her dismay, the employee simply took the bowl away and offered either a replacement or a 10-yuan refund, without any explanation or apology.
As the incident gained traction online, the stall owner issued a public apology. The owner later contacted the customer, promising to cover any medical expenses if necessary and offering compensation equal to 10 or even 100 times the cost of the meal. The owner also pledged to strengthen food safety management to prevent similar incidents.
According to Tianjin judicial authorities, the presence of foreign objects in food violates China's Food Safety Law, which prohibits the production or sale of food that is contaminated, adulterated or mixed with foreign matter.
商家提供的餐品中混有异物,违反上述相关法律规定,已构成生产经营不符合食品安全标准食品的行为,消费者有权依据相关法律规定主张赔偿。
消费者依法享有惩罚性赔偿请求权。根据《中华人民共和国食品安全法》第一百四十八条第二款规定,生产不符合食品安全标准的食品或者经营明知是不符合食品安全标准的食品,消费者除要求赔偿损失外,还可以向生产者或者经营者要求支付价款十倍或者损失三倍的赔偿金;增加赔偿的金额不足一千元的,为一千元。但是,食品的标签、说明书存在不影响食品安全且不会对消费者造成误导的瑕疵的除外。
Under the law, consumers are entitled to punitive damages. If a food product fails to meet food safety standards, consumers may claim compensation equal to 10 times the purchase price or three times the amount of the actual loss, with a minimum award of 1,000 yuan, unless the issue involves defects in the food's labeling or instructions that do not affect food safety or mislead consumers.
据此,消费者在遇到餐品中有异物或其他不符合食品安全标准的情形时,可以同时主张赔偿实际损失,以及主张惩罚性赔偿,即要求经营者按照餐费价款的十倍或实际损失三倍的标准进行赔付,如增加的赔偿金额不足一千元,可以按照一千元的赔偿标准主张权利。
维护自身权益应当在法律框架内进行,切莫触碰法律红线。
如果消费者基于真实消费经历,依据法律规定在合理的范围内主张相应的赔偿,属于正当维权行为,不构成违法犯罪。切勿以投诉、起诉等方式作为要挟手段,提出明显超出法定标准的不合理赔偿要求,此方式存在法律风险。
At the same time, authorities caution that consumers should exercise their rights within the bounds of the law. Using complaints or legal action to pressure businesses into paying compensation far exceeding the amount permitted by law may itself carry legal consequences. Legitimate claims based on genuine experiences and reasonable compensation requests, however, are fully protected by law and do not constitute extortion or any other legal violation.
建议首先与商家积极协商解决赔偿事宜,如协商不成,消费者可以向市场监督管理部门投诉举报,或准备民事起诉状、证据材料、身份材料以及餐饮企业信息向有管辖权的法院起诉,此外还可以通过具有调解职能的机构申请调解。
