男子设110为紧急联系人，醉酒后用辅助驾驶途中停车睡着，车企报警，男子辩称自首，法院判了

据扬子晚报，中国裁判文书网近日发布一起危险驾驶案。通过车机系统，将110设置为第二紧急联系人，周某一次醉酒后启用车辆驾驶辅助系统回家，途中停车上了趟厕所，结果返回车内后因困乏呼呼大睡。车企紧急救援中心发现异常后拨打预设紧急联系人110请求协助处置，最终周某被赶到的交警查出醉酒驾驶。

A drunk driver surnamed Zhou in Zhejiang province set 110 as his car's secondary emergency contact but failed to convince a court that the emergency call made by the automaker's emergency rescue center to police amounted to self-surrender, according to a judgment published on China Judgments Online.

浙江省缙云县人民法院审理查明，2026年3月19日19时许，周某醉酒后手动驾驶一辆小型普通客车从某村出发，准备回家。行驶途中，他启用了车辆辅助驾驶功能。车辆行驶至某路段时，周某因上厕所而停车，后返回车上睡觉，车辆未继续行驶但仍处于启动状态。

A court in Jinyun county found that Zhou drank before manually driving home on the evening of Mar 19, 2026. He later activated the vehicle's driver-assistance system. After stopping to use the bathroom, he returned to the car and fell asleep. The vehicle remained on but did not move.

20时03分，该品牌紧急救援中心因该车驾驶人员开车过程中长时间未接管车辆，呼唤无回应，于是拨打预设紧急联系人110请求协助处置。执勤民警到场后，发现周某涉嫌醉酒驾驶，将其当场查获。经鉴定，周某的血样乙醇含量为186mg/100mL。

At 8:03 pm, the automaker's emergency rescue center called 110, China's police hotline and Zhou's preset secondary emergency contact, after he had failed to take over the vehicle for a long time and did not answer. Officers arrived and found him suspected of drunk driving. His blood alcohol concentration was 186 mg per 100 mL.

周某归案后如实供述了犯罪事实，不过他认为，自己具有自首情节。其事先主动设置110作为第二紧急联系人，目的之一系在其出现违法犯罪行为时公安机关能够阻止其犯罪。其自愿预留接受公权力处置的渠道，在车机发出呼叫提醒后主动接管车辆，终止危险驾驶行为，虽具备逃跑条件却滞留现场等候民警，属于自动投案。

Zhou confessed after being arrested but argued that he had voluntarily surrendered. He said he had deliberately listed 110 as a backup contact so police could stop him if he committed an offense, and that he had stayed at the scene and waited for officers despite being able to flee. 

法院则认为，关于周某是否构成自首的问题，刑法第六十七条第一款规定，犯罪以后自动投案，如实供述自己的罪行的，是自首。在本案中，首先，从主观动机分析，周某并无主动投案或委托投案的主观意图。本案的求助行为是车机系统基于预设程序自动触发、车企依职责处置的结果，目的在于对驾驶人员实施救助，而非受周某委托代为向公安机关投案。

The court rejected the claim. It said Zhou had no intent to surrender or to ask anyone to surrender for him. The call was triggered automatically under preset rules and handled by the automaker as a rescue measure, not as a surrender on Zhou's behalf. 

其次，从客观表现分析，周某缺乏主动投案的行为表现。周某供述其在车内睡觉直至交警到场才苏醒，且车企紧急救援中心触发紧急联系人功能正是因为车辆长时间无人接管、驾驶人无应答。足见某救援中心求助时，周某已失去对车辆的实质管控能力，对车辆报警、公安机关处置等情况缺乏正常感知，不具备投案的意志自由和行为可能。

Besides, Zhou was asleep until police arrived. The emergency call was made precisely because he had not taken over the car and could not be reached. He had lost effective control of the vehicle and was not normally aware of the call or police response, so he lacked both the will and the ability to surrender. 

最终，法院作出判决：周某犯危险驾驶罪，判处拘役一个月，并处罚金人民币2000元。

The court convicted him of dangerous driving and sentenced him to one month of short-term imprisonment and a fine of 2,000 yuan.
