“患者送1.9元汽水后举报医生收礼”？医院回应
双语君约 4 分钟近日，一则“患者送1.9元汽水后举报医院药房工作人员违规收礼”的消息引起外界关注。
根据一张广东佛山12345工单回复截图显示，患者举报的是佛山复星禅诚医院有限公司药房一名梁姓工作人员，称对方违规收礼。

禅城区卫生健康局在回复工单上回应称：
“经了解，您多次到医院进行复诊，是该医院的老病患，该名工作人员未主动开口索取上述物品（健力宝蜂蜜口味汽水），主观认为这是老病患对于医务人员的感谢，因盛情难却而接收。送赠汽水行为为您个人主动行为，医院无权强制医生退还相关物品。
医院已对该医生收受市民物品的行为进行严厉批评，并对全院人员多次进行《医疗机构工作人员廉洁从业九项准则》培训。”
同时，禅城区卫生健康局在回复中还表示，会持续对医院医德医风问题进行监督，规范相关诊疗行为。
In a response filed through the city's 12345 government service hotline, the Chancheng District Health Bureau said Liang had not solicited the item, believing it was a gesture of thanks from a longtime returning visitor. Because the patient offered it voluntarily, the hospital could not compel its return.
It added that the hospital had sternly reprimanded Liang and repeatedly trained all staff on national rules governing professional conduct and integrity in medical institutions, and that oversight of medical ethics would continue.
一、此事发生在2022年，当时梁某诗在工作期间与一名在场群众相遇，对方主动从包内拿出饮料表示赠予，梁某诗已当场明确拒绝，因当时梁某诗忙于搬运物品，故无法将饮料推却，但梁某诗未饮用该饮料。
二、经核查，该医务人员未主动索取任何财物，事件中不存在请托事项和利益输送。该饮料系群众表达谢意的善意馈赠，价值约2元，性质上不构成违反医德医风的情形。
三、我院历来高度重视医德医风建设，严禁医务人员收受可能影响公正履职的馈赠。部分网络帖子将一瓶价值约2元的饮料与“受贿”关联，相关表述与事实不符，易引发公众误解。
四、相关不实信息已对当事医务人员个人名誉及我院声誉造成不良影响。当事人已向公安机关报案，事件正在依法处理中，最终结果以执法部门调查结论为准。
In a statement on Tuesday, the hospital said the incident dated back to 2022, when Liang clearly refused the item but was unable to push it away while moving items and did not consume it. A review found no request for favors or transfer of benefits.
It said the claims had harmed the reputations of Liang and the hospital, and that Liang had reported the matter to the police. The case is being handled in accordance with the law, and the final conclusion will rest on law enforcement findings.
据澎湃新闻，广东国鼎（深圳）律师事务所律师何生廷表示，《医疗机构工作人员廉洁从业九项准则》的规制对象主要为带有请托目的馈赠，比如患者希望通过送礼换取特殊关照、违规诊疗等不正当利益的情形。
本案中，患者主动赠送一瓶1.9元的饮料，没有附带任何特殊请求，医务人员也没有牟利意图，对于此类无利益交换、价值极其微薄的日常馈赠，在处置上不应严苛追责。
He Shengting, a lawyer in Shenzhen, said that those national rules mainly target gifts tied to improper requests, such as patients seeking special treatment or irregular services. Where no interests are exchanged, and the gift is extremely small, he said, harsh punishment is inappropriate.
