外甥正月理发舅舅去世竟成被告？法院判了！

2月21日，央视CCTV12社会与法频道《年关说案》播出一则案例，引发关注：外甥正月初二去理发，当晚舅舅遇车祸去世，舅妈控告他“故意杀人，赔100万”。

An absurd legal case has gained widespread attention as a nephew faced accusations of "intentional homicide" from his aunt after the tragic death of his uncle. The nephew, Liu Bing, was sued for 1 million yuan by his aunt, who claimed that his decision to get a haircut on the second day of the Chinese New Year caused her husband's fatal accident as a Chinese superstition goes that "cutting hair in the first month of Chinese New Year will lead to the uncle's death".

当地法院经过审理认为，民间习俗不能上升到道德层面绑架人。最终，法院依法驳回了原告舅妈的诉讼请求。

The dispute between Liu and his uncle arose on the second day of the Chinese New Year when the uncle expressed dissatisfaction with his nephwe's untidy hairstyle. In response, Liu promptly visited a barbershop. However, that same evening, the uncle, under the influence of alcohol, was involved in a fatal motorcycle accident, resulting in his untimely death.

第二天，刘兵得知舅舅去世的消息后，立刻前往吊唁。当舅妈看到赶来的刘兵理过发后，愤怒地指责他，认为他不该在正月初二这天去理发，因为这样会“死舅”。

Upon learning about the uncle's demise the following day, Liu rushed to offer his condolences. However, instead of receiving the heartfelt sympathies, he faced accusations from his aunt. She vehemently blamed him for her husband's death, asserting that his decision to get a haircut on the second day of the Chinese New Year led to the tragedy.

舅妈去公安机关控告刘兵间接故意杀人未果后，又将刘兵诉至法院，要求刘兵承担民事侵权赔偿责任，赔偿100万。

Unsuccessful in her attempt to file a case with the local police for indirect intentional homicide, the aunt pursued a lawsuit against Liu Bing in court, demanding 100,000 yuan in compensation. 

法院经过审理后认为，车祸的原因是舅舅酒驾导致的意外身亡，与刘兵正月初二理发并无任何关系，所以驳回了舅妈的诉讼请求。

The court, after careful examination, ruled that folk customs should not be elevated to a moral level to which would hold individuals accountable. The judge, in adherence to legal principles, dismissed the aunt's lawsuit, stating that there was no connection between Liu's haircut and the uncle's tragic accident.

不少网友表示，舅妈的做法实在是封建迷信：“这不是一句调侃吗？居然有人当真……”

还有了解的网友站出来科普，正月剪头民间说法是谐音传出来的！正确的应该是：正月剪头思旧。

资料显示，“正月理发死舅舅”的说法主要有两种来源。一说源自清军入关时的“剃发令”，满人要求汉人剃发留辫，但很多人认为“身体发肤，受之父母，不敢毁伤”，用各种理由搪塞拖着不剃，被认为是“思旧”。结果以讹传讹，“思旧”被传成了“死舅”、“死舅舅”。

另一种说法称，这句话因民国时期颁布的“剪辫令”而起。1921年1月，“剪辫令”发布。经过清朝200多年统治，留辫子成为很多人的习惯，不愿意剪。“剪辫令”实施恰逢正月，于是“剃头思旧”传成了“剃头死舅”。

两种说法都未经官方认定。

随着时代发展，“正月不理发”的习俗已经淡化了。有报道称，成年人开工前、孩子开学前，都是店里的客流高峰，大家对于“正月不理发”的态度也都是一笑了之。

节目最后也提醒民众：民间习俗要取其精华去其糟粕，应该弘扬符合社会发展进步的习俗，不能上升到道德层面绑架人。
