Chinese lawmakers on Friday passed a revised version of the law concerning public security administrative penalty, which will take effect from the beginning of next year.
宠物伤人可直接治安处罚
违反有关法律法规出售、饲养烈性犬等危险动物,将先处警告;
警告后仍不改正,或者致使动物伤害他人的,处五日以下拘留或者一千元以下罚款;
情节较重的,处五日以上十日以下拘留。
China has introduced tougher penalties for illegally selling or keeping aggressive dogs. Offenders will first receive a warning. If they refuse to comply or if the animal injures others, they face up to five days of detention or fines of up to 1,000 yuan. Serious cases carry detention of five to ten days.
The new rule targets the illegal trade of dangerous animals and strengthens public safety. It also gives residents stronger legal tools to protect themselves from dog attacks in public spaces.

明确正当防卫的合法性:新法明确规定,公民在面对不法侵害时,有权采取必要的防卫措施,保护自身或他人的人身、财产安全。 界定防卫限度:强调防卫行为应当在合理限度内,避免过度防卫导致不必要的损害。 免除法律责任:对于符合正当防卫条件的行为,免除其治安管理处罚责任,保障公民行使防卫权的合法性。 保护见义勇为:鼓励公民在他人遭受不法侵害时挺身而出,明确见义勇为行为受法律保护,避免因防卫行为受到不当处罚。 明确举证责任:在涉及防卫性措施的争议中,公安机关需充分调查取证,确保对防卫行为的认定客观公正。
The amended Law on Penalties for Administration of Public Security affirms citizens' right to take necessary defensive actions against unlawful infringement. It confirms the legality of self-defense while requiring such actions to stay within reasonable limits to prevent excessive harm.
The law exempts those who meet self-defense conditions from administrative penalties and offers clear legal protection for acts of bravery in helping others. Police are also required to conduct thorough investigations to ensure fair and objective assessments in self-defense cases.
14~18岁违法可拘留
对于14至16周岁一年内二次以上违反治安管理的未成年人,可以依法执行拘留。 14至16周岁以及16至18周岁初次违反治安管理,若情节严重、影响恶劣的,同样可以依法执行拘留。
According to the amended Law on Penalties for Administration of Public Security, minors — aged 14 to 16 — who disrupt social order or damage public security two or more times in a year will be subject to administrative detention.
The same penalty could be applicable to minors aged 14 to 18 even on a first offense if such offenses are committed under "serious circumstances" with "significant negative effect", according to the updated revised law adopted by the Standing Committee of the National People's Congress, China's top legislature, at the closing meeting of its latest session.

公安机关与学校协同治理
对组织、胁迫未成年人在不适宜未成年人活动的经营场所从事有偿陪侍活动的,公安机关将依法从严惩处,视情节轻重处以罚款、拘留等行政处罚; 构成犯罪的,将依法追究刑事责任。
It pointed out that the amended law also focuses on school bullying, with added content specifying that public security authorities should impose administrative penalties or take corrective education measures in cases involving assault, insult and intimidation.
Schools failing to report or handle serious bullying incidents will be ordered to make corrections, and responsible staff may be held accountable, the revised law noted.
It also requires police to notify a minor's adult relatives or school representatives to attend interrogations if the child's guardians cannot be present, the commission said, adding that the change is to better protect minors by streamlining the process of handling relevant cases.
