“鹅腿阿姨”回应“用鸭腿代替鹅腿”

6月9日,因在北大等高校附近摆摊走红的“鹅腿阿姨”,在一个团购群内发布公告称“因被举报,正在配合相关部门工作”。相关话题引发网友关注。

A street food vendor who became an internet sensation for selling grilled "goose legs" near top universities in Beijing has acknowledged that her popular snack is actually made from duck legs.

相关公告称,“原材料是鸭腿,以后都会给大家写清楚,介意请勿下单,‘鹅腿阿姨’叫了十几年了,不存在欺诈等行为”。

这则群公告一时间激起千层浪,很多曾经购买过鹅腿阿姨的“鹅腿”的大学生们表示非常震惊这一“指鸭为鹅”的行为。

据此前报道,陈秀凤2000年到北京谋生活,在北京大学西南门卖水果,后来开始改行卖“烤鹅腿”。2023年年底,清华、北大等高校学生排队买“鹅腿阿姨”鹅腿的视频被很多网友转发,“鹅腿阿姨”陈秀凤火爆出圈。 

Known as "Goose Leg Auntie", Chen Xiufeng rose to fame in late 2023 after students from Peking University and Tsinghua University were seen lining up at her stall. Although she only gained nationwide attention recently, the nickname had long been associated with her business around university campuses.

On Tuesday, Chen posted a notice in a group chat, saying she was cooperating with authorities following a complaint. In the notice, she wrote: "The main ingredient is duck leg, which will be clearly stated in the future. If that is a concern for you, please do not place an order. The name 'Goose Leg Auntie' has been used for over ten years. There was no intention to deceive."

爆火后,鹅腿阿姨陈秀凤还曾应北大创新学社邀请,走进北大百周年纪念讲堂分享感悟。陈秀凤表示,自己老家在江苏连云港,早年曾在北大西南门卖水果,后来发现卖烧烤收入更可观,便支了个烧烤摊开始卖“鹅腿”,后来为了方便学生预订鹅腿,她把自己的微信名字改为了“鹅腿阿姨”。

“鸭腿代替鹅腿”?当事人最新回应

6月10日上午,现代快报记者采访了“鹅腿阿姨”陈秀凤,她说,刚开始干的时候,确实卖的是鹅腿,但是后来进不到鹅腿食材了,所以就卖鸭腿了。

当记者询问后续食材会不会改成鹅腿,她表示,鹅腿和鸭腿都会用的,只要鹅腿好她就会用。同时陈秀凤透露,市场监管局目前还没有联系他们,但她正准备去市场监管局配合相关工作。 

Speaking to a reporter the following day, Chen said she had originally sold goose legs when she started the business but later switched to duck legs because she could not secure a stable supply of goose legs. She added that she would switch back to goose legs if a reliable supply becomes available.

陈秀凤的丈夫梁德才也告诉记者,当天他们不做生意了。 

鹅腿阿姨团购页面,页面显示“11518次接龙”。最新一次接龙中,接龙商品包括“阿姨烤的辣腿”“阿姨烤的不辣腿”,均未显示鸭腿或鹅腿。

此次事件在网上发酵后,不少人也在网上发声,有人认为“鹅腿阿姨”这就是一个品牌称呼,也有网友表示食材应该标注清楚,同时价格也要对应食材。

The revelation has sparked debate online. Some internet users argue that "Goose Leg Auntie" is simply a brand name and that customers buy the product for its taste rather than its ingredients. Others maintain that food vendors have a responsibility to accurately disclose what they are selling and that consumers have a right to know what they are purchasing.

天眼查App显示,陈秀凤已申请注册多枚“鹅腿阿姨”相关商标,国际分类涉及方便食品、食品、医疗园艺等,当前部分商标已注册成功。

当地市场监管部门:已接到线索

据@正在新闻 ,6月10日,北京燕园街道市监所工作人员表示,已接到相关线索,现在在尽快开展核实,对于是否属于虚假宣传,需要实地检查后再做出判断。

朝阳区市场监督管理局宣传科接线人员回应媒体称,已收到相关举报,目前还在了解此事。初步了解到的信息是,该摊主在朝阳区有一个线下配售点,正在进一步核实,如果确定系朝阳区管辖范围,会通过官方账号通报处理结果。

A staff member with the market regulator in Beijing's Chaoyang district confirmed that a complaint had been received and that an investigation is underway. The official added that the vendor operates a distribution point within the district.

浙江丰国律师事务所陈松涛表示,根据目前披露的信息,在法律上大概率已构成民事欺诈。

陈律师指出,根据《反不正当竞争法》第8条,经营者不得对其商品的性能、功能、质量、销售状况、用户评价、曾获荣誉等作虚假或者引人误解的商业宣传,欺骗、误导消费者。

“鹅腿阿姨”这一名称本身具有商业标识属性和明确指向性,消费者正是基于“鹅腿”二字产生购买行为,属于“引人误解的商业宣传”。同时,据目前信息来判断,“鹅腿阿姨”长期以该名义销售却未主动澄清实际材质,存在持续误导的嫌疑,法律上可认定为“隐瞒真相”。

Legal experts have also weighed in on the controversy. Chen Songtao, a lawyer with Zhejiang Fengguo Law Firm, said that based on the information currently available, the practice could constitute civil fraud.

He argued that the name "Goose Leg Auntie" carries a clear commercial meaning and that many consumers may have purchased the product believing it contained goose meat. Selling duck legs under that name for an extended period without clarification, he said, could be regarded as concealing material facts from consumers.
